1. contracting party
Unless expressly stated otherwise in the announcement, the contractual partner responsible for organizing the events is named as follows:
Feldberg Sports GmbH Address: Zweiseenblickweg 4b, 79868 Feldberg im Schwarzwald Hereinafter referred to as the "organizer".
2. Booking / Conclusion of Contract
By registering, the participant makes a binding offer to the organizer to conclude a contract in accordance with the information in the event announcement. The registration can be made in writing, orally or by telephone. If the participant makes registrations for other persons (e.g. children, friends, etc.), he assumes the contractual obligations both for himself and for the persons registered by him.
The contract is concluded when the organizer accepts the registration. This acceptance usually takes place by handing out or electronically transmitting a preliminary booking confirmation. If the content of the preliminary booking confirmation differs from the information in the registration, this constitutes a new offer on the part of the organizer, which is binding for a period of 10 days. The contract shall be concluded on the basis of this new offer if the participant declares acceptance to the organizer within this period or pays the event price.
3. services
The organizer undertakes to provide the services listed in the invitation to tender. Additional agreements and special requests can be made, and it is also possible for the organizer to make changes to the details stated in the invitation to tender before the contract is concluded.
4. booking and reservation of winter sports services and summer sports services (esp. bike)
Feldberg Sports GmbH, which has its operating site at Seebuck, acts as an agency for winter sports services and summer sports services. The mediation of the offer presented here is carried out on behalf of freelance winter sports instructors and bike guides. Feldberg Sports GmbH assumes no liability for personal injury or property damage incurred by course participants or third parties. In addition to the costs for the freelance ski instructors and bike guides, the price quoted also includes an agency fee charged by Feldberg Sports GmbH.
If course times are cancelled due to weather conditions, this does not entitle the participant to a refund of training fees already paid. In case of non-participation in arranged training services, no refund will be made. If the minimum number of participants is not reached, the agency reserves the right to reduce the course duration.
5. lift fees
The costs for lift tickets and ski equipment are not included in the course fee.
6. service changes
Changes or deviations of individual services from the agreed content of the contract, which become necessary after the conclusion of the contract and which were not caused by the organizer against good faith, are permitted, provided that these changes or deviations are not of a significant nature and do not significantly affect the overall character of the booked event or provided that the participant expressly declares his consent to the changes. In any case, the organizer will inform the participant as early as possible.
If, for example, an event is moved to an alternative, comparable venue due to unfavorable circumstances or other reasons beyond the control of the organizer, or if the planned route of a tour is changed, there is no entitlement to a refund or partial refund. The final decision on this lies with the organizer or the event manager responsible on site.
Any warranty claims remain unaffected insofar as the changed services are defective.
7. Cancellation:
Cancellation of a reservation must be made at least 48 hours in advance by mail to info(at)feldberg-sports.de. Otherwise the full rate will be charged according to the booking. Feldberg Sports reserves the right to replace unpaid reservations with paid reservations for group or private lessons.
8. withdrawal conditions:
Days used will be charged according to the rate. Each day used will be charged in full.
9. cancellation and withdrawal on the part of the organizer
The organizer or the responsible event manager appointed by him may terminate the contract immediately after the start of the event if the participant, despite prior warning by the organizer or the appointed event manager, significantly disrupts the event (for example, by insulting fellow travelers, public drug use, alcohol-related incidents, sexual harassment, etc.) or behaves in a manner contrary to the contract to an extent that justifies the immediate termination of the contract. In the event of such termination by the organizer, the organizer shall retain the right to the full event price.
10. cancellation or termination of an event due to weather conditions and force majeure
If the implementation of the event is significantly impeded, endangered or impaired due to unfavorable weather conditions (such as rain, strong winds/storms, thunderstorms) or due to force majeure (e.g. unacceptable weather conditions, pandemics, etc.), the organizer reserves the right to cancel the event until the start. The organizer or the responsible event manager appointed by him may also cancel the event at short notice after it has started if this is necessary due to force majeure. In such a case, the organizer may demand reasonable compensation for services already rendered or services still outstanding in connection with the termination of the event.
11. Liability:
Feldberg Sports assumes no liability for accidents that occur before, during or after the snow sports lessons and competitions. Participants are responsible for taking out their own accident or liability insurance.
12. minimum requirements:
The participant is obliged to inform himself about the minimum requirements of the event before concluding the contract and to clarify any questions with the organizer in advance of the booking. Unless specific requirements are stated, only the usual prerequisites such as normal physical and mental fitness, compliance with legal regulations (e.g. road traffic regulations, FIS rules) and proper use of sports equipment apply as a basis.
In order to protect both one's own health and that of the other participants, it is imperative to discuss any physical or mental limitations with both the attending physician and the organizer prior to the start of the event.
Should it become apparent after the start of the event that the participant does not meet the specified minimum requirements, the organizer or the responsible event manager appointed by him reserves the right to exclude the participant from the event even at a later date. This is done to protect the safety of the participant in question, the other participants and to ensure the successful running of the event. In such a case, there is no right to a refund of the event price.
13. data protection:
Feldberg Sports reserves the right to use any image material for marketing purposes. Guests can revoke permission to use and share their data and images at any time by sending a message to info@feldberg-sports.de. The data required for the business transaction will nevertheless be treated confidentially.
14. content of the online offer:
Feldberg Sports does not guarantee the timeliness, accuracy, completeness or quality of the information provided. Liability claims against Feldberg Sports, which refer to damages of a material or immaterial nature and were caused by the use or non-use of the information provided or by the use of incorrect and incomplete information, are excluded in principle, provided that there is no demonstrable intentional or grossly negligent fault on the part of the author.
All offers are non-binding and subject to change. Feldberg Sports expressly reserves the right to change, amend or delete parts of the pages or the entire offer without prior notice or to temporarily or permanently cease publication.
15. payment
Credit card payments in favor of the Ski School will be processed by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as "TREKKSOFT TOUR BOOKING" on your credit card statement. The domain where you enter and process your payment is owned and operated by TREKKSOFT. 16. place of jurisdiction
Lawsuits against the organizer have to be filed at the organizer's domicile. In the event of legal action on the part of the organizer against the participant, the place of residence of the participant shall be decisive, unless the legal action concerns registered traders or persons who have moved their place of residence or habitual abode abroad after conclusion of the contract, or whose place of residence or habitual abode is not known at the time the legal action is filed. In such situations, the organizer's registered office shall be the place of jurisdiction.
17. severability clause
The invalidity of individual provisions shall not affect the validity of the entire contract.
18. general:
Prices, times and offers can be modified at any time. We assume no liability for errors and misprints. All rights are reserved. The customer agrees to receive invoices in electronic form. Electronic invoices will be sent to the customer as PDF by e-mail.
